This website is (Website) operated by Zawawi Trading Co. LLC (“ZTC) or (“Mercedes-Benz Oman”). Access to this Website is subject to the terms and conditions of use outlined below.

Zawawi Trading Company LLC is the Authorized General Distributor of Mercedes-Benz in Oman (the “Authorized Territory”). This website only accepts and processes Orders within the Authorized Territory. If you choose another country for the product or vehicle registration or physical use which is beyond the Authorized Territory, you are advised to purchase the relevant vehicle or products from an authorized dealer who is authorized to deal, sell and market the vehicles or products in the final place of registration or location of use.

WEBSITE TERMS

Please read these Terms and any other terms of use posted on the Website as together they form our Website Terms governing your use of the Website and Website services. We may change these Website Terms from time to time without a prior notice to you by posting the updated Website Terms on the Website, so please be sure to check regularly for updates.

When you place an Order through the Website, you are deemed to have consented to the latest version of the Website Terms then posted on the Website. If a change in law leads to change the Website Terms after you have placed an Order but before it has been fulfilled, we are obliged to apply that change to your Order. In all other cases, the version posted at the time your Order was placed will apply.

If you do not agree to be bound by the Website Terms, you are requested not use the Website.

ELIGIBILITY

We aim to make the Website and its associated services available to as many of you as possible. However, we do require that you are at least 18 years of age, able to lawfully: (i) make payment through one of our accepted payment types; (ii) agree to these Terms; and (ii) enter into binding Orders with us.

The Website is for your personal use only and commercial usage is not permitted. We reserve the right to decline Orders where we suspect commercial usage.

ORDERS

The price of the parts and accessories shall be the retail price listed on the Website, is inclusive of VAT and excludes any other applicable costs.  When you place an order with us, then subject to your rights to cancel or return the parts and accessories, you, as a “Buyer,” commit to buy the item described in that order, at the price indicated including taxes and duties where applicable.

The “buyer” must provide accurate and current information when placing your order.  You are responsible for checking the relevant information that you submit with your order.  By submitting an order, you represent that all products, sizes, quantities and component variables listed in the order are correct. ZTC shall bear no responsibility for Buyer errors in submitting an order.

Orders are subject to our acceptance, which we may withhold at our sole discretion including for reasons such as ineligibility, inability to confirm payment authorization, suspected fraud, shipping restrictions and/or stock availability. Items ordered by you are only reserved until your Order has been finalized in accordance with these Terms.  Parts and accessories in your Website cart are not reserved until the check-out process is complete and payment is made. Parts and accessories in your Website cart may become unavailable during the period following addition to the cart and before confirmation by ZTC of receipt of the payment.

ZTC endeavors to present an accurate reflection of its inventory on the Website.  However, the quantities and specifications of the parts and accessories in stock should be considered an estimate and are subject to change based on availability.  The final transaction is subject to confirmation by ZTC, such confirmation to be provided by e-mail to you within seventy-two (72) hours of ZTC’s receipt of your payment.

Payments made on the Website to ZTC will be processed through “Checkout” payment gateway and Bank of Muscat or such other payment gateway or process provider (each a “Payment Gateway”) which we may choose.  Any payment made through the Website, and all associated details provided by you, shall be provided directly to a Payment Gateway via a secure connection. Payments may be made using a Visa or Mastercard credit or debit card in Omani Riyals or any other currency deemed acceptable by ZTC from time to time.

By submitting an online payment, you agree that any Payment Gateway may collect, use, store, process and transfer data received from you in order to process the payment and as required by applicable laws. You further agree that any Payment Gateway is permitted to transfer such data to any third party if required for successful completion of the payment process. In all cases ZTC shall comply with applicable laws related to personal data privacy. Other than as stated previously as required by the Payment Gateway under the Terms and Conditions, no credit or debit card details or other personally identifiable information supplied by you will be stored, sold, shared, rented or leased to any third parties.

ZTC will preserve all records related to purchases and refunds for two (2) years from the date such purchase or refund is processed.  By submitting an online payment, you agree that ZTC may keep records of such payment for up to two (2) years and permit any Payment Gateway to examine such records.

ZTC is not responsible for typographical or pricing errors. If an error is discovered, ZTC may cancel the sale. All prices, specifications and availability are subject to change without notice.

If, for any reason ZTC has underpriced a part or accessory in error, ZTC will not be liable to supply that part or accessory at that price.  Should you choose not to complete the purchase, your payment will be fully refunded on the credit card provided for the payment. There will be no cash refund from an on-line payment.

PRICES

Prices on the Website are displayed in Omani Rials (OMR) and include applicable taxes and may be subject to additional duties, fees and charges.

Where you purchase using a payment card denominated in a different currency to OMR, the payment will be subject to the currency exchange rate applied by your card issuer at the time your payment is completed.

All vehicle or products displayed on the Website, constitute an "invitation to offer". You agree to pay the full amount payable for the vehicle or products as indicated during the Order process, including any charges incurred with that Order.

Although we make every effort to ensure prices displayed on our Website and in our communications are accurate, errors may occur and subject to change.  If an error occurs after you have placed your Order whether it was processed or not, we have the right at our sole discretion to refuse or cancel any Orders placed for that vehicle.

PAYMENT

We currently accept the following payment types for deposits and orders paid on our Website: Visa, Mastercard and debit cards – only cards issued in Oman are accepted for payments.  It is mandatory to provide OTP / CVV information for payment processing. Payment will be taken at the time you place your Order. By entering payment details onto our Website, you warrant that you are duly authorized to pay using those details. We reserve the right to decline orders without liability to you where we believe payments are not authorized, the payment method is not valid or where we do not think you are authorized to use or utilize the relevant payment type.

DISCOUNT SCHEMES

Discount schemes are currently not available for Orders placed through the Website and we would ask you to contact our Zawawi Trading Co. L.L.C Sales Team directly.

DELIVERY PROCESS

The parts and accessories shall be made available for collection at one of the official ZTC facility address in Muscat, Sohar or Salalah.  Risk of loss and title for the parts and accessories passes to the Buyer upon handover of the parts and accessories to the Buyer.  The Buyer shall be responsible for bearing any shipping costs incurred and all VAT, export taxes and other fees associated with delivery of the parts and accessories.

Upon collection of the parts and accessories ZTC shall be released from all liability towards the Buyer in relation to the parts and accessories, and all responsibilities and risks associated after date and time of physical delivery will be the responsibility of the Buyer, except to the extent of any warranty purchased from ZTC applicable on the parts and accessories, in accordance with the terms and conditions of such warranty.

The Buyer commits to use the parts and accessories in accordance with applicable law. From the time of delivery, the Buyer is solely responsible for any use of the parts and accessories which results in a violation of any applicable law.

Should ZTC become aware of any circumstance that would render the sale of the parts and accessories to the Buyer in violation of any applicable law, including but not limited to the terms and conditions of the manufacturer, at any time during the period commencing on ZTC’s receipt of the down payment and prior to completion of the sale process, ZTC shall be entitled to terminate the sale process and any related contract(s) and reimburse to the Buyer any payments made to ZTC by the Buyer for the parts and accessories, less any costs incurred by ZTC.

The Buyer hereby agrees to unconditionally and irrevocably release and forever discharge ZTC from any and all claims, charges, complaints, actions, causes of action, defenses, demands, suits, representations, covenants or otherwise, relating to any matter, claim or right, which the Buyer has or may have against ZTC arising out of or in connection with the cancellation of the sale process in this regard.

CANCELLATION & REFUND POLICY

You may contact us at any time prior to your Order being confirmed by us to change it. If you do so, we will do our best to change it, subject to stock availability and any applicable price adjustment.

We will only refund an order if on physical inspection of the item or product, it appears that the reserved product is not as per the selected requirement at the time of order. The Refund will be processed within 30 days from the date of order or deposit cancelation. Refunds will be made to the original method of payment. The Buyer must request refund of their payment within thirty (30) days of purchase.  A refund will only be issued if the original receipt voucher is available.

PRODUCT LIABILITY

By placing an Order through our Website, you acknowledge and agree that full liability for the products or vehicles rests with the manufacturer and that we carry no product liability for those items.

INTELLECTUAL PROPERTY RIGHTS

Your use of the Website and its contents does not grant you any copyright, design, trademark or other intellectual property rights relating to the Content (as described in the Content section below), including our software, HTML or other code contained in the Website. All such Content including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Website is typically protected by national and international intellectual property laws and treaties. You are permitted to use the Content only as expressly authorized by us or the licensor of such Content.
